Probates for a Personal Representative

The following steps are required for a personal representative to have a will admitted to probate:
  1. Present the original will to the clerk of circuit court's office for proof (if there is not a self-proving clause in the will), either by the testimony or deposition of one of the subscribing witnesses or by 2 disinterested persons who can verify the handwriting and signature on a holographic (handwritten) will.
  2. Arrange for surety (security) on the bond unless it is waived by law or in the will.
  3. Furnish a List of Heirs at Law.
  4. While not absolutely necessary, you should call the clerk of circuit's office for an appointment. For the Office of the Clerk of Circuit Court for the city of Roanoke, call 540-853-6711 or 540-853-6712.
Probate fees are based on the value of the estate and may be paid with cash, check or a Visa or MasterCard credit/debit card. Effective July 1, 2012, the following service fees apply if using a Visa or MasterCard credit/debit card. The service fee for charges $50 and under will be $2. The service fee for charges over $50 will be assessed at 4%.
